Terms and Conditions

This agreement sets forth the entire agreement between Clear the Air LLC and Clear Advantage Member. Representations and promises made by any other person not contained in this document are not part of this agreement.

1.    Repairs will be made during normal working hours, unless home is without cooling or heating.  Emergency services are available seven days a week, 24 hours per day. Trucks are stocked with parts for most repairs. Some repairs will require parts from manufacturer and Clear the Air – Air Conditioning & Heating cannot accept responsibility for parts not being immediately available. There will be a normal service call fee for repair calls, but never a after hours fee or overtime fee. Tune ups are included in the cost of the agreement.

2.    Preventative Maintenance (Tune-Up) are to be scheduled and done at the company’s discretion. This allows us to schedule during slower times and relieve some of the workload during the peak season. For this, you are given generous discounts.

3.    We shall perform two preventive maintenance tune-ups per consecutive 12-month period.  These inspections & tune-ups will be performed on during regular working hours:  8am to 5pm Monday through Friday. This agreement does not include any labor, materials or replacement parts necessary for repairs of the listed equipment.

4.    Homeowner is responsible for the following: blown fuses other than those in equipment, circuit breakers, open disconnects or electrical switches, high-voltage wiring, physical damage to low-voltage wiring, changing or cleaning disposable filters (filter changing or cleaning service can be added to agreement for nominal fee).

5.    Membership does not include electronic air cleaners, zoning equipment or air purification equipment unless added to membership prices.

6.    Clear the Air LLC will not be responsible for structural alterations of the premises necessary to service equipment; incidental, consequential, or special damages including loss of property due to failure of covered equipment.

7.    New members who own Clear the Air systems with expired parts and labor warranty or systems installed by other dealers must have systems checked out and any repairs made before purchasing #3 program

8.    Equipment exceeding ten years of age will not be covered under #3 program.

9.    Members can not use a preventative maintenance tune-up as a service dispatch. Any problems must be addressed as a Service Dispatch.

* Customer must commit for 12 months. If you fail to complete your 12 mo. agreement, you will be billed for whatever services we have performed at our regular rates less what you have paid toward your contract.  Billed by Credit/Debit Card Only

* Accrual of discounts per year of membership will be for customers who keep membership current and do not allow membership to expire. Any laps in membership will void all credit and will have to start over again.  Credits can be used to purchase installations of any brand of equipment installed by our company. Credits cannot be used for any other purchases (i.e. repairs, memberships, etc.). Credits can be transferred along with the membership itself to new owners of the property, but cannot be transferred to a different property/location.

* #3 program will only be available after a proper inspection has been done and ALL repairs have been made and the system is up to code.
